Safeguarding Privacy Notice

Who We Are

Nuneaton and Bedworth Borough Council collects and processes personal data to fulfil its statutory safeguarding duties. We are committed to being transparent about how we collect and use your data and to meeting our data protection obligations under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Purpose for Processing Your Information

We process personal data to deliver safeguarding services that protect children and adults at risk. This includes responding to safeguarding concerns, coordinating with external agencies, and ensuring the safety and wellbeing of individuals in our community.

Legal Basis for Processing Your Information

Under the UK GDPR, the Council must have a lawful basis to process personal data. For safeguarding purposes, we rely on the following:

- Article 6(1)(c)  Processing is necessary for compliance with a legal obligation.

- Article 6(1)(e)  Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

Where special category data is processed (e.g. health, ethnicity, or criminal offence data), we rely on:

- Article 9(2)(g)  Processing is necessary for reasons of substantial public interest.

- Article 9(2)(h)  Processing is necessary for the provision or management of health or social care services.

These are supported by Schedule 1 of the Data Protection Act 2018, which includes provisions for safeguarding children and individuals at risk.
Relevant legislation includes:
 The Children Act 1989 and 2004
 The Care Act 2014
 Working Together to Safeguard Children (statutory guidance)

What Information We Collect

We may collect and hold the following types of personal data:
- Name
- Date of birth
- Address
- Contact details (phone, mobile, email)
- Nature of safeguarding concern
- Referrals to external agencies
- Information about family members or associates (where relevant)

How We Collect Information

We collect information through:
 Our websites and online forms
 Paper forms and contracts
 Correspondence with you
 Referrals from other agencies
 Information provided by family, friends, neighbours, or other individuals

If you provide personal information about others, we assume you do so with their knowledge and consent.

How We Use Your Information

We use your information to:
 Respond to safeguarding concerns
 Coordinate with external agencies
 Maintain accurate records of support provided
 Identify safeguarding trends
 Ensure staff training is appropriate and effective
 Support case reviews and service improvement

Sharing Your Information

We may share safeguarding information with other agencies (e.g. social services, police, health professionals) where there is a concern about the safety or welfare of a child or adult.

We will seek consent where possible. However, in certain circumstances, we may share information without consent if it is necessary to protect someone from harm. The reasons for not obtaining consent will be documented.

How Long We Keep Your Information

Safeguarding records are retained for the current year + six years then reviewed after this (to establish whether they are retained). After this period, data will be securely deleted or anonymised if it is no longer required.

Security of Your Information

We take appropriate measures to protect your personal data, including:
 Secure databases with restricted access
 Staff training on data protection and safeguarding
 Regular audits and reviews of data handling practices

Your Rights

Under data protection law, you have rights including:
 The right to access your personal data
 The right to request correction of inaccurate data
 The right to object to processing (in certain circumstances)
 The right to request erasure (where applicable)
