Don't Fall 'Foul' of the Law

Dog owners are being reminded that failing to clean up after their pet could have expensive consequences after three people were prosecuted by the courts.
 
Fines totalling almost £2,500 were shared between three individuals in a single morning at the Warwickshire Justice Centre.  The three people all live in Nuneaton and were pursued through the courts by the Council as each failed to pay a £50 fixed penalty notice issued to them after they failed to clean up after their dog had fouled.
 
Matthew Brookes of Coronation Court, Mount Street, Nuneaton, was issued with a Dog Fouling Fixed Penalty Notice on 12/07/2011, and a second on 21/07/2011.  In his absence in court, he was found guilty on two counts of failing to clear up dog fouling on Pool Bank Street Recreation Ground, and was ordered to pay a total of £1,226.80 fine and court costs.
 
Lesley Proctor of Queensway, Nuneaton was ordered to pay a total of £613.40 for fine and court costs having failed to pay a Fixed Penalty Notice issued on 01/08/2011 for failing to clean up dog fouling on Abbey Green.
 
Joanne Bloxham of Queens Road, Nuneaton, was issued with a Dog Fouling Fixed Penalty Notice on 08/08/2011 and charged with failing to clear up dog fouling on Pool Bank Street Recreation Ground.  She was convicted of the offence in her absence in court and ordered to pay out a total of £613.40 for the fine and costs.
 
All three cases were heard by Magistrates in Nuneaton on Monday, January 30 2012.
 
Councillor Bill Sheppard, the Cabinet member for health and environment, said:
“The Council does not want to be pursuing people through the courts like this but it is the only way that some offenders will get the message that dog fouling will not be tolerated in our Borough.  Children and families who use our parks and open spaces should not have their enjoyment spoiled by inconsiderate owners who fail to clean up after their dogs.  This should send a clear message to dog owners to clean up or pay the penalty!”
 
In the last 12 months, 37 Fixed Penalty Notices have been served by the Council for Dog Fouling.  When a fixed penalty is not paid we pursue the offender through the courts utilising the Dogs Fouling of Land Act 1996.  Others who have not paid in the last 12 months have also received fines from the court ranging from £200 - £500 for similar offences.
