Tenancy Issues

Deals with all tenancy matters relating to council owned properties. This covers, succession to a tenancy, lodgers, sub-letting, joint tenancies, assignment of tenancy, changes to tenancy agreement and termination of tenancies.

The rights and responsibilities of both the Council and its tenants can be found in the Council's standard Tenancy Agreement which is available to view or download below.
 

Joint Tenancy

If you have a joint tenancy you are held jointly and individually responsible for the tenancy, including any arrears that may accrue. The tenancy conditions apply to both parties. If you do wish to give up your half of the tenancy, both tenants will need to see their Housing Officer and sign an agreement to this affect.
 

Subletting a Property

You cannot sublet the whole of your property to another person. If you wish to sublet part of the property, you must first obtain the Council’s written approval and put your request in writing giving names, address and date of birth(s) of the person(s) you wish to sublet part of your property to.
 

Ending a Tenancy 

  • If you are leaving your property, you must give us at least four weeks notice in writing, expiring at 12 noon on a Monday that you wish to end the tenancy.
  • If you have a Joint Tenancy, either of you may end the tenancy by giving notice.  If you hand in the keys to your property without giving four weeks notice, you will be charged 4 weeks rent.
  • You must give us vacant possession and return all keys, including any communal door entry keys/fobs and garage keys, at the end of the tenancy.
  • Please remove all of your furniture, personal possessions and rubbish, and leave the premises in a good lettable state.
  • We may charge you for removing any possessions left, along with any damage caused to the premises, fair wear and tear excepted.
  • Please ensure that when you hand in your keys you leave a forwarding address should we require any further contact and ensure that your rent account is cleared at the time of your move.
  • Please also inform us of the name of your gas, electricity, and telephone supplier.
  • If you also rent a Council Garage, please include the address with your property address.
  • When you are leaving your property, please remember to:
  1. Have your gas/electric meters read;
  2. Notify all concerned of your new address;
  3. Leave your property and the garden tidy and clean for the next tenant;
  4. Turn off your central heating;
  5. Turn off your gas/electric at the mains;
  6. Turn off your water at the stopcock;
  7. Hand in your keys, which should include any garage keys with the address of the garage you rent clearly marked on them together with any main entrance door keys or fobs if you live in a flat with a door entry system;
  8. Complete the Customer Satisfaction Survey on the back of the Termination of Tenancy Form.

Changes to a Tenancy

You may have changes to a tenancy if tenant passes away; you wish to take in a lodger; one of the joint tenants wishes to leave, or you wish to change the name on the tenancy.
 
  • Contact the Housing Officer if you need to change a tenancy.
  • Please provide details of name, address, tenancy reference.
 
A Tenancy can, by law, pass to someone else. If a tenant passes away, the tenancy will normally be transferred to the partner or spouse if they have been living in the same property for the previous 12 months and can provide proof.
 
  • The person succeeding to the tenancy will have to sign an agreement and the rent account will be changed to their name. If there is no partner, another member of the family who has resided in the property for a minimum of 12 months prior to the death of the tenant may be able to succeed to the tenancy.
  • If you are a joint tenant and one of the tenants dies, the remaining tenant will automatically become the sole tenant but the tenancy will have to be amended accordingly, a copy of the death certificate is required before the tenancy can be changed.
 

You must notify the Council of your intention to take in a lodger

  • Contact the Housing Officer if you wish to apply to take in a lodger.
  • Please provide details of name, date of birth, tenancy reference and the date you wish your lodger to move.
  • If you give notice to terminate your tenancy, a lodger will not have the right to remain in the property and must vacate at the same time as you.
  • If you receive Housing Benefit and take in a lodger, you must notify the Housing Benefit Department so that they can reassess your entitlement.
  • Where deterioration of your home or any communal area is due to the neglect or default of your lodger, sub tenant, or visitor, you must take the necessary steps as are reasonable for the removal of the lodger, sub tenant or visitor.
 

Floating Support Schemes

Nuneaton & Bedworth have a number of Floating Support Schemes in the area, that provide help and support for people who are finding it difficult to look after their home or pay their bills.  By working together support workers can offer support services designed to meet the individual needs and help the tenant maintain their tenancy.  They work closely with Social Services, Health and Housing to tackle issues that will help towards maintaining an independent lifestyle.
 
The service is aimed at first time tenancies, vulnerable lonely or isolated individuals, those with limited life skills, no support networks, budgeting or money management problems, mental health or learning difficulties, alcohol or substance misuse.

With the assistance to DAMAT (Domestic Violence Multi-Agency Team) to provide a comprehensive support service for families and individuals suffering or who have suffered domestic violence. 
 
The Warwickshire Housing Drug Support Scheme – contact 09126 884136
This service is provided to those people with drug misuse and the service enables tenants to maintain their tenancy, offers counselling and help, assistance with maximising benefits, budgeting and health advice.
