Eviction Advice

If a tenant fails to pay rent or breaches any aspects of their tenancy agreement the local authority has the right to evict the tenant by applying to the court to repossess the property.

Most tenants will automatically become secure tenants after 12 months. If you break any of your tenancy conditions if, for example, you fail to pay your weekly rent; you or your visitors cause nuisance or annoyance to anyone in the locality of your home, the Council may wish to end the tenancy.
 

Eviction Procedure

  • To bring your tenancy to and end, the Council must serve you with a Notice of Possession Proceedings.  This will inform you that the Council will be asking the County Court for an immediate possession order.
 
  • If you receive a notice, please contact your housing officer immediately.
 
  • If you receive a Notice of Possession Proceedings it means that the Council intends to obtain an order for possession from the Court and you will be evicted.
 
  • As an introductory tenant, you will have the right to request a review of the Council’s decision to evict you. A form to request a review will be attached to the Notice of Possession Proceedings.
 
  • Please note the Council must receive your written request for a review within 14 days from the Notice of Proceedings was served on you.
 
  • Once the review request has been received by the Council, an acknowledgment will be sent to you within three working days.
 
  • A review will be arranged at least five days after your request form has been received unless there are any special circumstances.
 
  • You will be notified of the decision of the review Panel before the date indicated on the Notice of Possession Proceedings when the Council can apply to Court.
