The council has responsibility for acting on reports of flytipping to both remove the waste and to locate and prosecute the offenders, and arrange the removal of the waste with the landowners. Where the flytipping is on private land it is the landowner's responsibility, but the council will encourage the landowner to remove it and will take enforcement action where necessary. Where the waste is hazardous the council or landowner has responsibility to ensure public safety until such time as the waste can be removed.
The council will prosecute offenders where possible.
The council has an obligation to remove flytipping from public areas.

Any vehicles involved - their make, colour and registration number
- Private land – the owner is responsible. The council can notify the land owner of their obligations if you report an issue with flytipping. Refuse & cleansing will arrange to visit the site and determine cost for removing waste and provide quotation (if on private land).
- If on public land – Refuse & cleansing officer will visit the location to determine what equipment is needed to clean up the site.
- This work will be programmed in and will be cleaned up when resources allow.
Conditions
- Private land – the owner is responsible.
- If you are the owner of Private Land, the refuse & cleansing team can be contacted to arrange a visit to the site and determine cost for removing waste and provide quotation (if on private land). A minimum charge of £30 will apply.
- If you are not the owner the council can be contacted to notify the land owner of their obligations.
