Contracts have to be performed in accordance with the requirements set out in the contract documentation. Contract conditions will be strictly applied.
 
This Council is continuously striving to improve its own performance and it expects its contractors to do the same.
 
It is the intention of this Council to ensure that suppliers and contractors are fully aware of the requirements of the Council's contracts. To this end pre-tender discussions relating to contracts with potential suppliers and contractors are encouraged.
 

Complaints Procedure

The Council will adopt a variety of contracts monitoring arrangements appropriate to the value and nature of each contract. Most complaints will be discussed and resolved through these arrangements. However, if any contractor or supplier has a complaint about unfair treatment or discrimination that cannot be resolved through normal commercial contact with the Council, the complaint can be made in writing through Nuneaton and Bedworth Borough Council's Corporate Complaints Procedure. This procedure details the policy for dealing with complaints and ensures that the Council acts promptly.

Anyone who has supplied a tender to the Council under the European Public Procurement Rules can take action in the High Court if they have been harmed, or are at risk of harm by the Council breaking these regulations. Anyone who feels they have not been treated fairly can also complain to the European Commission.
 

Confidential Reporting Code

The Council also has a separate policy concerning "confidential reporting" (sometimes called "whistle blowing") which is in addition to the corporate complaints procedure and other statutory reporting procedures operating in some departments.
 
In line with the Council’s commitment to the highest possible standards of openness, probity and accountability, it encourages all employees and others that we deal with, who have serious concerns about any aspect of the Council’s work, to come forward and voice those concerns confidentially. This also applies to contractors working for the Council on Council premises, for example, agency staff, builders and drivers. It also covers suppliers and those providing services under a contract with the Council in their own premises.
